These Terms of Service ("Terms") govern your use of the services provided by Rekade LTD ("Rekade," "we," "us," or "our") including web hosting, virtual private servers (vServers), domains, and dedicated servers (collectively, the "Services"). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Prohibited Uses You may not use our Services for the following purposes:

• Mining.
• Continuous full utilization of the Services.
• Abuse, including but not limited to operating dstats, botnets, or engaging in account grabbing.
• Any activity that is illegal under UK laws or regulations.

2. Service Use You agree not to misuse our Services, including but not limited to:

• Attempting to gain unauthorized access to any portion of our Services, or any other systems or networks connected to our Services.
• Probing, scanning, or testing the vulnerability of any system or network connected to our Services.
• Interfering with or disrupting the integrity or performance of our Services or the data contained therein.
• Using our Services to transmit any malicious software or code.

3. Suspension and Termination We reserve the right to suspend or terminate your access to our Services at any time and for any reason, including but not limited to your violation of these Terms or applicable laws and regulations.

4. Chargebacks and Unauthorised Payment Reversals
   Any attempt to initiate a chargeback or reverse a payment will result in the immediate and permanent termination of all services and the customer relationship. This includes any pending or future access to services or support. Unjustified chargebacks are considered a breach of contract and may be subject to legal action to recover losses, fees, and associated costs.

5. Disclaimer of Warranties Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, secure, or error-free.

6. Limitation of Liability In no event shall Rekade LTD, its directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our Services.

7. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts of the United Kingdom.

8. It is not possible to transfer servers and accounts. Neither by the support team nor by yourself.

9. Changes to Terms We reserve the right to modify these Terms at any time. Any changes to these Terms will be effective immediately upon posting. Your continued use of our Services after any such changes constitutes your acceptance of the revised Terms.

11. Additionally, for Dedicated Servers with Windows as the OS, you must maintain an account named "CloudInit." Under no circumstances should this account be deleted. Deleting this account may result in suspension
12. We do not provide refunds for suspension or cancellation or any other reasons under any circumstances, in accordance with UK laws.
13. Cancellation of services is possible in two forms. Immediately and on a desired date. In the case of immediate cancellation, the service will be cancelled immediately.
14. FairUse Traffic. Users are expected to engage in fair and responsible utilization of server resources. Activities such as website hosting, application deployment, and standard server operations are permitted within reasonable limits. Abuse of resources, illegal activities, excessive resource consumption, file sharing, and traffic-intensive services are prohibited. Violations may result in warnings, suspensions, bandwidth throttling, or account termination.
15. Reselling products that have been purchased at a discount through the affiliate programme is prohibited and may result in a permanent ban and a kick out of the affiliate programme.
16. General reselling is not prohibited, but written authorisation from the management is required.
17. SMTP traffic is generally prohibited in our network. However, exceptions can be discussed with support. (At least third-level employees.)
18. It is forbidden for KVM servers to run permanently at full load. Failure to do so may result in the service being blocked.

By accepting/reading these terms and conditions you agree that the right of cancellation expires and your service will be provided immediately.
